1 Acceptance of Terms

Welcome to SparkMyClass ("the Platform"). The Platform is operated by Pickmy AI Limited ("we", "us"). By using the Platform, you agree to comply with the following Terms of Service. If you do not agree to these terms, please do not use the Platform.

2 Service Description

SparkMyClass is a gamified classroom management platform that provides teachers with the following features:

• Classroom creation and student management
• Behavior point tracking system
• Interactive quiz games
• Presentation mode (device-free projected interaction)
• Visual seating chart management
• Pet evolution reward system
• Random grouping tool
• Class story wall

3 Plans and Payment

3.1 Free and Paid Plans

The Platform offers a Free plan and a paid Pro plan. The Free plan includes basic features; the Pro plan unlocks all advanced features. Please refer to the pricing page for full details on features and pricing.

3.2 Payment Method

Paid plans are processed through PayPal. The Platform does not collect, store, or process any credit card or payment card information. All payment data is handled directly by PayPal and is subject to PayPal's terms of use and privacy policy.

3.3 One-Time Annual Payment

The Pro plan is a one-time annual payment of HKD 188/year. There is no automatic renewal or recurring charge. When your plan expires, you may choose to manually renew by making a new payment. After expiry, your account will revert to the Free plan until you renew.

3.4 Refunds

If you are not satisfied with the service, you may request a full refund within 7 days of purchase. To request a refund, please email [email protected] with your account details. Purchases older than 7 days are non-refundable.

4 User Accounts

4.1 Registration

You must provide accurate personal information to create an account. You are responsible for maintaining the security of your account, including keeping your password safe. If you discover any unauthorised use of your account, please notify us immediately.

4.2 Teacher Responsibilities

As a teacher user, you are responsible for:

• Ensuring you have the right to enter student data into the Platform
• Obtaining parental or guardian consent where applicable
• Properly managing student accounts in your classes
• Ensuring teaching content complies with local laws and regulations
• Not using the Platform to discriminate against or unfairly treat students

4.3 Student Accounts

Student accounts are created and managed by teachers. Students join classrooms using a class code provided by their teacher. Student accounts are used solely for classroom interaction and do not contain personal email or contact information.

5 Acceptable Use

When using the Platform, you agree not to:

• Upload or share any illegal, harmful, threatening, abusive, or inappropriate content
• Attempt to gain unauthorised access to the Platform or other users' accounts
• Use automated tools to scrape data from the Platform
• Interfere with or disrupt the normal operation of the Platform
• Impersonate other users or entities
• Use the Platform for commercial purposes (unless written permission is obtained)
• Upload viruses, malicious code, or other harmful content

6 Intellectual Property

6.1 Platform Content

The design, code, images, logos, and text content of the Platform are protected by intellectual property laws and are owned by Pickmy AI Limited. They may not be reproduced, modified, distributed, or otherwise used without written permission.

6.2 User Content

You retain ownership of the content you upload to the Platform (such as quiz questions and teaching materials). You grant the Platform a non-exclusive licence to use this content to provide the service. This licence terminates when you delete your account or the relevant content.

7 Data Export and Portability

You may request to export your account data at any time, including classroom data, student records, and point history. To request a data export, please contact us via email and we will provide it within a reasonable timeframe.

8 Service Changes and Termination

We reserve the right to:

• Modify, suspend, or discontinue any part or all of the Platform's features at any time
• Suspend or terminate your account for violation of these terms
• Adjust service plans and pricing (existing paid plans will not be immediately affected)

Users will be notified of significant changes via email or platform notification within a reasonable timeframe.

9 Disclaimer

The Platform is provided on an "as is" and "as available" basis. We do not guarantee:

• That the service will be uninterrupted or error-free
• The accuracy or completeness of the content
• That the Platform will meet all your specific requirements
• Absolute security of data transmission

To the maximum extent permitted by law, we shall not be liable for any direct or indirect losses arising from the use of the Platform.

10 Limitation of Liability

In no event shall Pickmy AI Limited be liable for any indirect, incidental, special, consequential, or punitive damages, whether or not such damages are foreseeable. Our total liability shall not exceed the total fees paid by you to the Platform in the preceding 12 months.

11 Governing Law

These terms are governed by the laws of the Hong Kong Special Administrative Region. Both parties agree that any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

12 Amendments

We may amend these Terms of Service from time to time. Amended terms will be published on this page with an updated "Last updated" date. Significant changes will be notified via email. Continued use of the Platform constitutes acceptance of the amended terms.
